Je zak\u00e1z\u00e1no pronaj\u00edmat kr\u00e1tkodob\u011b, pouze na obdob\u00ed pr\u00e1zdnin a dovolen\u00fdch? Mus\u00edm se coby pronaj\u00edmatel p\u0159ihl\u00e1sit u p\u0159\u00edslu\u0161n\u00e9ho \u00fa\u0159adu pro cestovn\u00ed ruch?<\/strong><\/p>\n<p>V\u00a0posledn\u00edch t\u00fddnech se v\u00a0tisku objevily prvn\u00ed zpr\u00e1vy o novink\u00e1ch v\u00a0pravidlech pro turistick\u00e9 pron\u00e1jmy v\u00a0Andalusii, a tak se pokus\u00edme v\u00a0tomto \u010dl\u00e1nku objasnit n\u011bkter\u00e9 z\u00a0\u010detn\u00fdch dotaz\u016f, kter\u00e9 jsme na toto t\u00e9ma obdr\u017eeli.<\/p>\n<p>Po posledn\u00edch zm\u011bn\u00e1ch v\u00a0Z\u00e1kon\u011b o m\u011bstsk\u00fdch pron\u00e1jmech (LAU), ustanoven\u00fdch z\u00e1konem 4\/2013 ze 4. \u010dervna, kter\u00e9 se pokusily zpru\u017enit a podpo\u0159it trh s\u00a0pron\u00e1jmy, byla ta \u010d\u00e1st z\u00e1kona, kter\u00e1 reguluje \u201edo\u010dasn\u00e9 p\u0159enech\u00e1n\u00ed kompletn\u011b za\u0159\u00edzen\u00e9 nemovitosti, p\u0159ipraven\u00e9 k\u00a0okam\u017eit\u00e9mu u\u017eit\u00ed, nab\u00edzen\u00e9 a inzerovan\u00e9, kde c\u00edlem je zisk\u201c, vy\u0148ata z\u00a0regulace celost\u00e1tn\u00ed a odk\u00e1z\u00e1na na m\u00edstn\u00ed specifickou normativu.<\/p>\n<p>Turistick\u00e9 pron\u00e1jmy tedy p\u0159e\u0161ly do kompetence jednotliv\u00fdch autonomn\u00edch oblast\u00ed. Autonomie, kde m\u00e1 cestovn\u00ed ruch nejv\u011bt\u0161\u00ed v\u00e1hu, jako jsou Katal\u00e1nsko, Bale\u00e1rsk\u00e9 a Kan\u00e1rsk\u00e9 ostrovy, ji\u017e k\u00a0t\u00e9to regulaci p\u0159istoupily. Andalusie tak \u010din\u00ed nyn\u00ed, dekretem 28\/2016 ze dne 2. \u00fanora 2016. Publikace prob\u011bhla ve ve\u0159ejn\u00e9m v\u011bstn\u00edku andalusk\u00e9 vl\u00e1dy (tzv. BOJA) dne 11. \u00fanora 2016 a <strong>vstoupen\u00ed v\u00a0platnost je dle z\u00e1v\u011bre\u010dn\u00e9ho \u010dtvrt\u00e9ho odstavce stanoveno na 12. kv\u011btna 2016. <\/strong><\/p>\n<h4>Jak\u00e9 byly d\u016fvody pro tuto zm\u011bnu v\u00a0z\u00e1kon\u011b?<\/h4>\n<p>D\u016fvody jsou r\u016fzn\u00e9 a jejich vysv\u011btlen\u00ed je obsa\u017eeno v\u00a0samotn\u00e9m pr\u00e1vn\u00edm textu:<\/p>\n<ul>\n<li>Siln\u00fd tlak ze strany podnikatelsk\u00fdch kruh\u016f z\u00a0oblasti cestovn\u00edho ruchu a hoteli\u00e9rstv\u00ed, a to kv\u016fli tzv. nekal\u00e9 konkurenci ze strany t\u011bchto \u201e soukrom\u00fdch pron\u00e1jm\u016f\u201c, kter\u00e9 nepodl\u00e9haj\u00ed \u017e\u00e1dn\u00e9 regulaci ani kontrole. S\u00a0p\u0159\u00edchodem a masivn\u00edm roz\u0161\u00ed\u0159en\u00edm internetov\u00fdch aplikac\u00ed a platforem do\u0161lo k\u00a0z\u00e1sadn\u00edm zm\u011bn\u00e1m v\u00a0situaci na trhu, kdy u\u017eivatel v\u00a0podstat\u011b disponuje neomezen\u00fdm p\u0159\u00edstupem k\u00a0nab\u00eddk\u00e1m tohoto typu ubytov\u00e1n\u00ed za mnohem v\u00fdhodn\u011bj\u0161\u00ed ceny<\/li>\n<li>Pot\u0159eba ustanovit alespo\u0148 minim\u00e1ln\u00ed pravidla a z\u00e1ruky kontroly, kvality slu\u017eeb a bezpe\u010dnosti u\u017eivatel\u016f turistick\u00e9ho ubytov\u00e1n\u00ed<\/li>\n<li>Bezpe\u010dnostn\u00ed d\u016fvody. Ubytovac\u00ed za\u0159\u00edzen\u00ed, kter\u00e1 podl\u00e9haj\u00ed regulaci, jsou povinna registrovat pohyb osob, jejich p\u0159\u00edjezdy a odjezdy<\/li>\n<li>Ochrana \u017eivotn\u00edho prost\u0159ed\u00ed. D\u0159\u00edve prim\u00e1rn\u011b reziden\u010dn\u00ed \u010d\u00e1sti m\u011bst se prom\u011bnily v\u00a0oblasti s\u00a0obrovsk\u00fdm pohybem turist\u016f, kte\u0159\u00ed vyhled\u00e1vaj\u00ed levn\u011bj\u0161\u00ed ubytov\u00e1n\u00ed mimo centrum<\/li>\n<li>Pot\u0159eba impulzu turistick\u00e9mu ruchu a snaha tuto aktivitu, kter\u00e1 se stala sou\u010d\u00e1st\u00ed \u0161ed\u00e9 ekonomiky, dostat do zdaniteln\u00e9 oblasti. Jde o z\u00e1sadn\u00ed motor \u0161pan\u011blsk\u00e9 ekonomiky a st\u00e1t si nem\u016f\u017ee dovolit p\u0159ij\u00edt o dan\u011b z\u00a0toho plynouc\u00ed.<\/li>\n<\/ul>\n<h4>Co je to turistick\u00e1 \u010di pr\u00e1zdninov\u00e1 nemovitost?<\/h4>\n<p>Dle \u010dl\u00e1nku 3 Dekretu jde o takov\u00e9 bytov\u00e9 jednotky, kter\u00e9 jsou um\u00edst\u011bn\u00e9 v\u00a0oblastech klasifikovan\u00fdch jako reziden\u010dn\u00ed, kde se b\u011b\u017en\u00fdm zp\u016fsobem nab\u00edz\u00ed ubytov\u00e1n\u00ed turist\u016fm, a to v\u00fdm\u011bnou za finan\u010dn\u00ed obnos, tedy cenu. Coby b\u011b\u017en\u00fd zp\u016fsob a nab\u00eddku turist\u016fm je pova\u017eov\u00e1no to, \u017ee nemovitost je nab\u00edzena pomoc\u00ed zp\u016fsob\u016f, b\u011b\u017en\u00fdch pro cestovn\u00ed ruch ( cestovn\u00ed kancel\u00e1\u0159e, zprost\u0159edkovatel\u00e9 ubytov\u00e1n\u00ed, internet, mobiln\u00ed aplikace, atd., kte\u0159\u00ed nab\u00edzej\u00ed pron\u00e1jem a obsahuj\u00ed mo\u017enost rezervace).<\/p>\n<h4>Co na z\u00e1klad\u011b tohoto z\u00e1kona nebude pova\u017eov\u00e1no za turistickou \u010di pr\u00e1zdninovou nemovitost?<\/h4>\n<p>\u010cl\u00e1nek 1.2 Dekretu vyj\u00edm\u00e1 n\u00e1sleduj\u00edc\u00ed:<\/p>\n<ul>\n<li>Nemovitosti, kter\u00e9 budou p\u0159enech\u00e1ny zdarma, i kdy\u017e jejich \u00fa\u010delem je turistika \u010di dovolen\u00e1<\/li>\n<li>Nemovitosti pronajat\u00e9 t\u00e9 stejn\u00e9 osob\u011b \u2013 u\u017eivateli nep\u0159eru\u0161en\u011b po dobu p\u0159ekra\u010duj\u00edc\u00ed dva m\u011bs\u00edce<\/li>\n<li>Nemovitosti na venkov\u011b, kter\u00e9 podl\u00e9haj\u00ed specifick\u00e9 regulaci<\/li>\n<li>T\u0159i \u010di v\u00edce bytov\u00fdch jednotek spole\u010dn\u011b, pokud pat\u0159\u00ed stejn\u00e9mu majiteli a nach\u00e1zej\u00ed se ve stejn\u00e9 nemovitosti \u010di v\u00a0souboru nemovitost\u00ed, jeliko\u017e ty u\u017e podl\u00e9haj\u00ed p\u0159edpis\u016fm t\u00fdkaj\u00edc\u00edm se turistick\u00fdch apartm\u00e1n\u016f<\/li>\n<\/ul>\n<p><strong>Na z\u00e1klad\u011b interpretace ji\u017e zmi\u0148ovan\u00e9ho \u010dl\u00e1nku 3 Dekretu lze tedy doj\u00edt k\u00a0z\u00e1v\u011bru, \u017ee zm\u011bny se net\u00fdkaj\u00ed bytov\u00fdch jednotek a nemovitost\u00ed, kter\u00e9 jsou pronaj\u00edm\u00e1ny sporadicky, na obdob\u00ed krat\u0161\u00ed ne\u017e dva m\u011bs\u00edce, kter\u00e9 nejsou nab\u00edzeny zp\u016fsoby b\u011b\u017en\u00fdmi v\u00a0turistick\u00e9m ruchu (cestovn\u00ed kancel\u00e1\u0159e, zprost\u0159edkovatelsk\u00e9 spole\u010dnosti, aplikace, je\u017e umo\u017e\u0148uj\u00ed rezervaci). To znamen\u00e1, \u017ee pokud se nab\u00eddka ubytov\u00e1n\u00ed t\u00edmto zp\u016fsobem neprezentuje, ubytovac\u00ed kapacity nepodl\u00e9haj\u00ed t\u00e9to regulaci dle v\u00fd\u0161e uveden\u00e9ho dekretu a nemus\u00ed tedy spl\u0148ovat podm\u00ednky v\u00a0n\u011bm obsa\u017een\u00e9.<\/strong><\/p>\n<h4>Jak\u00e9 podm\u00ednky mus\u00ed spl\u0148ovat turistick\u00e9 \u010di pr\u00e1zdninov\u00e9 ubytov\u00e1n\u00ed?<\/h4>\n<p>Dle \u010dl\u00e1nku 6 jde o n\u00e1sleduj\u00edc\u00ed:<\/p>\n<ul>\n<li>Mus\u00ed m\u00edt kolauda\u010dn\u00ed souhlas<\/li>\n<li>Pokoje mus\u00ed m\u00edt venkovn\u00ed v\u011btr\u00e1n\u00ed nebo alespo\u0148 do patia a okna mus\u00ed b\u00fdt opat\u0159ena n\u011bjak\u00fdm syst\u00e9mem zatemn\u011bn\u00ed<\/li>\n<li>Mus\u00ed b\u00fdt dostate\u010dn\u011b za\u0159\u00edzeny a vybaveny k\u00a0okam\u017eit\u00e9mu u\u017eit\u00ed v\u00a0z\u00e1vislosti na po\u010dtu l\u016f\u017eek, kter\u00fdmi disponuj\u00ed<\/li>\n<li>Pokud se nab\u00edz\u00ed v\u00a0obdob\u00ed od kv\u011btna do z\u00e1\u0159\u00ed, mus\u00ed disponovat klimatizac\u00ed (pevn\u011b instalovan\u00e9 jednotky). V\u00a0obdob\u00ed \u0159\u00edjen a\u017e duben mus\u00ed m\u00edt topen\u00ed. Majitel\u00e9 maj\u00ed lh\u016ftu na adaptaci, a to v d\u00e9lce jednoho roku od vstupu normy v\u00a0platnost.<\/li>\n<li>Disponovat l\u00e9k\u00e1rni\u010dkou<\/li>\n<li>M\u00edt k\u00a0dispozici turistick\u00e9 informace o lokalit\u011b, m\u00edsta k\u00a0z\u00e1bav\u011b, restaurace, obchody, parkovi\u0161t\u011b, l\u00e9ka\u0159sk\u00e9 slu\u017eby, dopravn\u00ed prost\u0159edky, pl\u00e1nky a pr\u016fvodce<\/li>\n<li>Disponovat knihou p\u0159\u00e1n\u00ed a st\u00ed\u017enost\u00ed<\/li>\n<li>Zajistit \u00faklid p\u0159i p\u0159\u00edjezdu a odjezdu nov\u00fdch klient\u016f<\/li>\n<li>Disponovat lo\u017en\u00edm pr\u00e1dlem a ru\u010dn\u00edky v\u00a0z\u00e1vislosti na ubytovac\u00ed kapacit\u011b, v\u010detn\u011b kompletu pro v\u00fdm\u011bnu<\/li>\n<li>Poskytnout telefonn\u00ed kontakt na majitele \u010di provozovatele pro p\u0159\u00edpad pot\u0159eby<\/li>\n<li>Poskytnout manu\u00e1ly k\u00a0u\u017eit\u00ed dom\u00e1c\u00edch spot\u0159ebi\u010d\u016f<\/li>\n<\/ul>\n<p>\u010cl\u00e1nek 5 Dekretu rozli\u0161uje dva typy ubytov\u00e1n\u00ed:<\/p>\n<ul>\n<li>Kompletn\u00ed: pokud je nab\u00edzena nemovitost jako celek<\/li>\n<li>\u010c\u00e1ste\u010dn\u00e9, po jednotliv\u00fdch pokoj\u00edch: v\u00a0tom p\u0159\u00edpad\u011b tam mus\u00ed majitel tak\u00e9 bydlet<\/li>\n<\/ul>\n<p>Samotn\u00e9 u\u017eit\u00ed je limitov\u00e1no na z\u00e1klad\u011b zn\u011bn\u00ed kolauda\u010dn\u00edho souhlasu pro danou nemovitost. V\u00a0p\u0159\u00edpad\u011b kompletn\u00edho u\u017eit\u00ed nelze p\u0159ekro\u010dit 15 ubytovac\u00edch m\u00edst, v\u00a0p\u0159\u00edpad\u011b pron\u00e1jmu po pokoj\u00edch je to 6. Nav\u00edc \u00a0v obou p\u0159\u00edpadech je stanoven limit 4 osob na pokoj.<\/p>\n<h4>Co mus\u00edm ud\u011blat v\u00a0p\u0159\u00edpad\u011b, \u017ee moje nemovitost spad\u00e1 do kategorie turistick\u00e9ho \u010di pr\u00e1zdninov\u00e9ho ubytov\u00e1n\u00ed?<\/h4>\n<p>P\u0159ed zah\u00e1jen\u00edm poskytov\u00e1n\u00ed slu\u017eeb je majitel \u010di provozovatel povinen nahl\u00e1sit tuto \u010dinnost u p\u0159\u00edslu\u0161n\u00e9ho \u00fa\u0159adu pro cestovn\u00ed ruch (Consejer\u00eda de Turismo). Sou\u010d\u00e1st\u00ed odpov\u00eddaj\u00edc\u00edho prohl\u00e1\u0161en\u00ed je i spln\u011bn\u00ed podm\u00ednek uveden\u00fdch v\u00a0Dekretu. Pot\u00e9 je mo\u017eno zah\u00e1jit inzerci i \u010dinnost.<\/p>\n<p>Dekret obsahuje i z\u00e1kladn\u00ed po\u017eadavky, kter\u00e9 mus\u00ed \u010destn\u00e9 prohl\u00e1\u0161en\u00ed obsahovat:<\/p>\n<ul>\n<li>Identifika\u010dn\u00ed \u00fadaje nemovitosti, v\u010detn\u011b katastr\u00e1ln\u00edch \u00fadaj\u016f a tak\u00e9 kapacitu za\u0159\u00edzen\u00ed<\/li>\n<li>\u00dadaje o majiteli a doru\u010dovac\u00ed adresu<\/li>\n<li>\u00dadaje provozovatele v\u00a0p\u0159\u00edpad\u011b, \u017ee tyto jsou odli\u0161n\u00e9 od majitele. Smlouvu mezi majitelem a provozovatelem. V\u00a0p\u0159\u00edpad\u011b, \u017ee nemovitost vlastn\u00ed v\u00edce osob, provozovatel mus\u00ed m\u00edt smlouvu s\u00a0ka\u017ed\u00fdm z\u00a0nich<\/li>\n<\/ul>\n<p>Nemovitosti budou \u00fa\u0159edn\u011b zaregistrov\u00e1ny v\u00a0odpov\u00eddaj\u00edc\u00edm Rejst\u0159\u00edku cestovn\u00edho ruchu Andalusie. Zah\u00e1jen\u00ed a ukon\u010den\u00ed \u010dinnosti bude sd\u011bleno odpov\u00eddaj\u00edc\u00edm m\u011bstsk\u00fdm \u00fa\u0159ad\u016fm a \u00fa\u0159ad\u016fm, kter\u00e9 maj\u00ed v\u00a0kompetenci bydlen\u00ed.<\/p>\n<p>Po \u0159\u00e1dn\u00e9m z\u00e1pisu ve zmi\u0148ovan\u00e9m registru majitel \u010di provozovatel obdr\u017e\u00ed sv\u016fj k\u00f3d, jen\u017e mus\u00ed b\u00fdt povinn\u011b uv\u00e1d\u011bn ve ve\u0161ker\u00e9 reklam\u011b \u010di nab\u00eddce ubytov\u00e1n\u00ed.<\/p>\n<h4>Mohu se ji\u017e p\u0159ihl\u00e1sit k\u00a0\u010dinnosti?<\/h4>\n<p>Junta de Andaluc\u00eda p\u0159es sv\u00e9 \u00fa\u0159edn\u00edky potvrdila, \u017ee toto je mo\u017en\u00e9, ov\u0161em a\u017e do chv\u00edle, kdy norma vstoup\u00ed v\u00a0platnost (12. kv\u011btna 2016), nen\u00ed mo\u017eno \u017eadatel\u016fm vystavit registra\u010dn\u00ed k\u00f3d. Zde je na m\u00edst\u011b upozornit, \u017ee jeliko\u017e norma vstupuje v\u00a0platnost na za\u010d\u00e1tku turisticky nejaktivn\u011bj\u0161\u00edho obdob\u00ed roku, je velmi pravd\u011bpodobn\u00e9, \u017ee v\u00a0tu chv\u00edli bude velk\u00fd p\u0159etlak \u017e\u00e1dost\u00ed. S\u00a0ohledem na mo\u017en\u00e9 sankce bychom tedy doporu\u010dili p\u0159edlo\u017eit \u00fa\u0159ad\u016fm dokumentaci co nejd\u0159\u00edve.<\/p>\n<p>Nen\u00ed nutno, aby p\u0159\u00edlohou \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed byla dokumentace k\u00a0nemovitosti, jako potvrzen\u00ed o vlastnictv\u00ed, kolaudace, apod.\u00a0 M\u011bla by b\u00fdt ov\u0161em k\u00a0dispozici v\u00a0dan\u00e9 nemovitosti pro p\u0159\u00edpad kontroly.<\/p>\n<p>\u010cestn\u00e9 prohl\u00e1\u0161en\u00ed je mo\u017eno podat online, pokud disponujete autorizovan\u00fdm digit\u00e1ln\u00edm podpisem. V\u00a0opa\u010dn\u00e9m p\u0159\u00edpad\u011b existuje specifick\u00fd formul\u00e1\u0159, kter\u00fd je t\u0159eba vyzvednout, vyplnit, podepsat a podat u p\u0159\u00edslu\u0161n\u00e9ho \u00fa\u0159adu provincie, kam nemovitost spad\u00e1.<\/p>\n<p>Pod\u00e1n\u00ed \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed u p\u0159\u00edslu\u0161n\u00e9ho \u00fa\u0159adu umo\u017e\u0148uje zah\u00e1jit \u010dinnost, a to p\u0159esto, \u017ee odpov\u00eddaj\u00edc\u00ed registra\u010dn\u00ed k\u00f3d d\u00e1le povinn\u00fd k\u00a0provozov\u00e1n\u00ed \u010dinnosti je\u0161t\u011b nen\u00ed k\u00a0dispozici.<\/p>\n<h4>Kdo je zodpov\u011bdn\u00e1 osoba a jak\u00fd je syst\u00e9m pokut a sankc\u00ed?<\/h4>\n<p>Dle \u010dl\u00e1nku 4 je z\u0159ejm\u00e9, \u017ee pro \u00fa\u0159ady je za zodpov\u011bdnou osobu pova\u017eov\u00e1n provozovatel \u010dinnosti. A priori maj\u00ed \u00fa\u0159ady za to, \u017ee provozovatelem je majitel (nebo majitel\u00e9), mimo p\u0159\u00edpady, kdy bude v\u00a0\u010destn\u00e9m prohl\u00e1\u0161en\u00ed jasn\u011b smluvn\u011b dokumentov\u00e1no, \u017ee tomu tak nen\u00ed.<\/p>\n<p>Co se t\u00fd\u010de syst\u00e9mu pokut, \u010dl\u00e1nek 10 Dekretu n\u00e1s odkazuje na odstavec VIII. Kopie smlouvy o poskytnut\u00ed slu\u017eeb, \u0159\u00e1dn\u011b podepsan\u00e1 klientem, mus\u00ed b\u00fdt k\u00a0dispozici kompetentn\u00edm org\u00e1n\u016fm po dobu jednoho roku.<\/p>\n<p>Smluvn\u00ed strany si mohou svobodn\u011b dohodnout \u010das p\u0159\u00edjezdu a \u010das odjezdu. Pokud nen\u00ed dohodnuto nic, bude se m\u00edt za to, \u017ee pr\u00e1vo na u\u017eit\u00ed ubytov\u00e1n\u00ed za\u010d\u00edn\u00e1 v\u00a016:00 hodin prvn\u00edho smluven\u00e9ho dne, a kon\u010d\u00ed ve 12:00 hodin posledn\u00edho smluven\u00e9ho dne.<\/p>\n<h4>Eviden\u010dn\u00ed kniha ubytovan\u00fdch<\/h4>\n<p>Provozovatel slu\u017eby je povinen vyplnit a odeslat zpr\u00e1vu o po\u010d\u00e1tku ubytov\u00e1n\u00ed Policii \u010di Guardii Civil. V\u0161ichni ubytovan\u00ed star\u0161\u00ed 16 let jsou povinni vyplnit a podepsat zpr\u00e1vu o po\u010d\u00e1tku ubytov\u00e1n\u00ed, kter\u00e1 by m\u011bla obsahovat alespo\u0148 n\u00e1sleduj\u00edc\u00ed \u00fadaje: \u010d\u00edslo, typ a datum vyd\u00e1n\u00ed p\u0159edlo\u017een\u00e9ho osobn\u00edho dokladu, \u00fapln\u00e9 jm\u00e9no, pohlav\u00ed, datum narozen\u00ed a st\u00e1tn\u00ed ob\u010danstv\u00ed, datum p\u0159\u00edjezdu a registra\u010dn\u00ed \u010d\u00edslo ubytovac\u00edho za\u0159\u00edzen\u00ed (\u010di \u00fadaje o provozovateli).<\/p>\n<p>Z\u00a0t\u011bchto zpr\u00e1v bude vytvo\u0159ena eviden\u010dn\u00ed kniha ubytovan\u00fdch, kterou je provozovatel povinen uchov\u00e1vat po dobu t\u0159\u00ed let.<\/p>\n<p>Informace, obsa\u017een\u00e9 v\u00a0t\u011bchto eviden\u010dn\u00edch zpr\u00e1v\u00e1ch, je nutno sd\u011blit policejn\u00edm org\u00e1n\u016fm ve lh\u016ft\u011b 24 hodin od zah\u00e1jen\u00ed ubytov\u00e1n\u00ed, a to jak\u00fdmkoli z\u00a0n\u00ed\u017ee uveden\u00fdch zp\u016fsob\u016f:<\/p>\n<ul>\n<li>Osobn\u00ed p\u0159ed\u00e1n\u00ed na p\u0159\u00edslu\u0161n\u00e9m policejn\u00edm komisa\u0159stv\u00ed \u010di stanici Guardia Civil nebo zasl\u00e1n\u00ed faxem, p\u0159\u00edpadn\u011b formou CD, diskety, apod.<\/li>\n<li>Provozovatel se mus\u00ed dostavit na p\u0159\u00edslu\u0161n\u00e9 komisa\u0159stv\u00ed a po\u017e\u00e1dat o zp\u0159\u00edstupn\u011bn\u00ed informa\u010dn\u00edho syst\u00e9mu, kter\u00fd mu umo\u017en\u00ed elektronick\u00e9 zas\u00edl\u00e1n\u00ed \u00fadaj\u016f.<\/li>\n<\/ul>\n<h4>Cena a rezervace<\/h4>\n<p>Ceny turistick\u00e9ho ubytov\u00e1n\u00ed mohou b\u00fdt stanoveny zcela svobodn\u011b.<\/p>\n<p>Je nutno je prezentovat na viditeln\u00e9m m\u00edst\u011b dan\u00e9ho turistick\u00e9ho ubytov\u00e1n\u00ed.<\/p>\n<p>Ceny, stejn\u011b tak jako faktury za odpov\u00eddaj\u00edc\u00ed skute\u010dn\u011b poskytnut\u00e9 nebo objednan\u00e9 slu\u017eby, mus\u00ed b\u00fdt uvedeny v\u00a0jednotliv\u00fdch polo\u017ek\u00e1ch a seps\u00e1ny minim\u00e1ln\u011b ve \u0161pan\u011bl\u0161tin\u011b.<\/p>\n<p>Ceny v\u0161ech nab\u00edzen\u00fdch slu\u017eeb mus\u00ed b\u00fdt kone\u010dn\u00e9 a kompletn\u00ed, v\u010detn\u011b dan\u00ed. V\u00a0p\u0159\u00edpad\u011b, \u017ee existuje nav\u00fd\u0161en\u00ed ceny nebo sleva, mus\u00ed to b\u00fdt n\u00e1le\u017eit\u011b rozpolo\u017ekov\u00e1no. V\u017edy bude sou\u010d\u00e1st\u00ed ceny dod\u00e1vka vody, elektrick\u00e9 energie, topen\u00ed, klimatizace, \u00faklid p\u0159i p\u0159\u00edjezdu a pou\u017eit\u00ed lo\u017en\u00edho pr\u00e1dla a ru\u010dn\u00edk\u016f.<\/p>\n<p>Cenov\u00e9 podm\u00ednky, podm\u00ednky rezervace, z\u00e1lohy, \u010di p\u0159\u00edpadn\u00e9ho zru\u0161en\u00ed rezervace se budou \u0159\u00eddit dohodou stran. V\u00a0ka\u017ed\u00e9m p\u0159\u00edpad\u011b ov\u0161em tyto budou zve\u0159ejn\u011bny p\u0159edem.<\/p>\n<p>V\u00a0moment\u011b rezervace by m\u011bl b\u00fdt vyd\u00e1n doklad, kter\u00fd bude obsahovat dohodnut\u00e9 podm\u00ednky. V\u00a0p\u0159\u00edpad\u011b, \u017ee nen\u00ed dohodnuto jinak, provozovatel je p\u0159i rezervov\u00e1n\u00ed opr\u00e1vn\u011bn po\u017eadovat maxim\u00e1ln\u011b 30% z\u00a0celkov\u00e9 ceny za ubytov\u00e1n\u00ed.<\/p>\n<p>V\u00a0p\u0159\u00edpad\u011b zru\u0161en\u00ed rezervace ze strany klienta je provozovatel opr\u00e1vn\u011bn zadr\u017eet a\u017e 50% zaplacen\u00e9 z\u00e1lohy v\u00a0p\u0159\u00edpad\u011b, \u017ee je rezervace zru\u0161ena do 10 dn\u016f p\u0159ed datem p\u0159\u00edjezdu, a celkovou \u010d\u00e1stku v\u00a0p\u0159\u00edpad\u011b, \u017ee ke zru\u0161en\u00ed dojde v\u00a0krat\u0161\u00edm p\u0159edstihu.<\/p>\n<h4>Syst\u00e9m zdan\u011bn\u00ed<\/h4>\n<p>Dan\u00ed se stejn\u00fdm zp\u016fsobem, jako u m\u011bstsk\u00fdch pron\u00e1jm\u016f (LAU), tj. p\u0159\u00edjmy se zahrnou do celkov\u00fdch p\u0159\u00edjm\u016f z\u00a0\u010dinnosti do ro\u010dn\u00edho da\u0148ov\u00e9ho p\u0159izn\u00e1n\u00ed (IRPF).
