odpov\u00eddaj\u00edc\u00ed \u00fadr\u017ebu nemovitosti, m\u00edstn\u00ed dan\u011b a poplatky, p\u0159\u00edpadn\u011b i m\u011bs\u00ed\u010dn\u00ed \u00fav\u011brov\u00e9 spl\u00e1tky.<\/li>\n<\/ul>\n<p>Je ov\u0161em pravda, \u017ee takov\u00fd pron\u00e1jem se m\u016f\u017ee prom\u011bnit i ve velk\u00fd probl\u00e9m, p\u0159edev\u0161\u00edm pokud se nedodr\u017e\u00ed ur\u010dit\u00e9 z\u00e1sady.\u00a0\u0160pan\u011blsk\u00e1 legislativa souvisej\u00edc\u00ed s pron\u00e1jmem nemovitost\u00ed je mo\u017en\u00e1 a\u017e p\u0159\u00edli\u0161 benevolentn\u00ed v\u016f\u010di n\u00e1jemc\u016fm a ochran\u011b jejich z\u00e1jm\u016f a m\u00edstn\u00ed syst\u00e9m soud\u016f je bohu\u017eel na hony vzd\u00e1len rychlosti a pru\u017enosti, je\u017e by byla v \u0159e\u0161en\u00ed tohoto typu spor\u016f \u017e\u00e1douc\u00ed.\u00a0Je tak\u00e9 skute\u010dnost\u00ed, \u017ee sou\u010dasn\u00e1 vl\u00e1da u\u010dinila n\u011bkter\u00e9 zm\u011bny s \u00fa\u010dinnost\u00ed od \u010dervna 2013, kter\u00e9 maj\u00ed za c\u00edl podpo\u0159it pron\u00e1jmy a u\u010dinit je pru\u017en\u011bj\u0161\u00edmi.\u00a0Absolutn\u00ed v\u011bt\u0161ina pronaj\u00edmatel\u016f nezn\u00e1 odpov\u00eddaj\u00edc\u00ed legislativu a nen\u00ed si v\u011bdoma d\u016fsledk\u016f (i trestn\u00fdch), je\u017e s sebou m\u016f\u017ee n\u00e9st ur\u010dit\u00fd zp\u016fsob jedn\u00e1n\u00ed v\u016f\u010di n\u00e1jemc\u016fm.<\/p>\n<p>Pot\u00e9, co n\u00e1jemce obdr\u017e\u00ed kl\u00ed\u010de k nemovitosti a tuto p\u0159evezme, p\u0159ech\u00e1z\u00ed na n\u011bj cel\u00e1 \u0159ada pr\u00e1v, je\u017e mu budou n\u00e1le\u017eet i v p\u0159\u00edpad\u011b, \u017ee p\u0159estane platit n\u00e1jem a nebude respektovat domovn\u00ed \u0159\u00e1d \u010di bude poru\u0161ovat dobr\u00e9 mravy v nemovitosti. Jedin\u00fdm zp\u016fsobem, jak jej vyst\u011bhovat, je implikovat advok\u00e1ta a podat odpov\u00eddaj\u00edc\u00ed soudn\u00ed \u017ealobu. Takov\u00fd proces m\u016f\u017ee b\u011b\u017en\u011b trvat 5 a\u017e 9 m\u011bs\u00edc\u016f, v z\u00e1vislosti na vyt\u00ed\u017eenosti relevantn\u00edho soudu.<\/p>\n<p>B\u011bhem cel\u00e9 t\u00e9to doby i za p\u0159edpokladu, \u017ee n\u00e1jemce neplat\u00ed n\u00e1jem a nechov\u00e1 se v souladu s dobr\u00fdmi mravy, by majitel v \u017e\u00e1dn\u00e9m p\u0159\u00edpad\u011b nem\u011bl m\u011bnit z\u00e1mky, vstupovat do nemovitosti bez dovolen\u00ed, ukon\u010dit smlouvy s dodavateli energi\u00ed, \u010di pokusit se o vyst\u011bhov\u00e1n\u00ed silou. V\u0161echny tyto alternativy \u0159e\u0161en\u00ed, je\u017e se nab\u00edzej\u00ed samy, jsou kvalifikov\u00e1ny jako trestn\u00e9 (vyhro\u017eov\u00e1n\u00ed, n\u00e1tlak) a mohou m\u00edt pro majitele odpov\u00eddaj\u00edc\u00ed d\u016fsledky.<\/p>\n<p>Je tak\u00e9 vhodn\u00e9 rozli\u0161ovat mezi smlouvami k pron\u00e1jmu kr\u00e1tkodob\u00e9mu a dlouhodob\u00e9mu. Druh\u00e9 zm\u00edn\u011bn\u00e9 se ze z\u00e1kona obnovuj\u00ed automaticky ka\u017ed\u00fd rok, a to po obdob\u00ed t\u0159\u00ed let. V praxi to znamen\u00e1, \u017ee i dobr\u00fd n\u00e1jemce, je\u017e \u0159\u00e1dn\u011b plat\u00ed n\u00e1jem, se m\u016f\u017ee prom\u011bnit<br \/>v probl\u00e9m v p\u0159\u00edpad\u011b, \u017ee vlastn\u00edk nemovitosti pot\u0159ebuje z\u00edskat zp\u011bt svou nemovitost k u\u017e\u00edv\u00e1n\u00ed p\u0159ed ukon\u010den\u00edm t\u00e9to z\u00e1konn\u00e9 t\u0159\u00edlet\u00e9 lh\u016fty.<\/p>\n<p>Velmi b\u011b\u017en\u00fdm omylem je v\u011b\u0159it, \u017ee smlouva na obdob\u00ed krat\u0161\u00ed ne\u017e 12 m\u011bs\u00edc\u016f je kr\u00e1tkodob\u00e1, a \u017ee nad 12 m\u011bs\u00edc\u016f jde o smlouvu dlouhodobou. Do\u010dasnost smlouvy je d\u00e1na skute\u010dnost\u00ed, \u017ee v nemovitosti n\u00e1jemce nehodl\u00e1 ustanovit sv\u00e9 trval\u00e9 bydli\u0161t\u011b, ale \u017ee ji pot\u0159ebuje pro p\u0159echodn\u00e9 obdob\u00ed (do\u010dasn\u00fd p\u0159esun z pracovn\u00edch d\u016fvod\u016f, \u00fa\u010dast na kurzu s omezen\u00fdm trv\u00e1n\u00edm, dovolen\u00e1, apod.). Soudce takto m\u016f\u017ee pova\u017eovat 18 ti m\u011bs\u00ed\u010dn\u00ed smlouvu za smlouvu kr\u00e1tkodob\u00e9ho charakteru a naopak 11 ti m\u011bs\u00ed\u010dn\u00ed za dlouhodobou v z\u00e1vislosti na tom, zda nemovitost slou\u017e\u00ed jako trval\u00e9 bydli\u0161t\u011b n\u00e1jemce \u010di nikoliv.<\/p>\n<p>I z tohoto d\u016fvodu je zcela z\u00e1sadn\u00ed, aby n\u00e1jemn\u00ed smlouva byla p\u0159ipravena advok\u00e1tem s c\u00edlem ochr\u00e1nit va\u0161e z\u00e1jmy coby vlastn\u00edka.<\/p>\n<p>Vicente &amp; Otaolaurruchi v\u00e1m p\u0159edkl\u00e1d\u00e1 n\u00e1sleduj\u00edc\u00ed doporu\u010den\u00ed, kter\u00e1 by m\u011bla p\u0159isp\u011bt k tomu, aby byla rizika pokud mo\u017eno minimalizov\u00e1na:<\/p>\n<ul>\n<li>Podepisujte pouze n\u00e1jemn\u00ed smlouvy p\u0159ipraveny va\u0161\u00edm advok\u00e1tem speci\u00e1ln\u011b pro v\u00e1s a va\u0161i nemovitost.
